1.- INTRODUCTION / ABOUT…

DEPARTOURING, SL acts as a direct agent, on behalf of the different transport providers to third parties, hereinafter “The Providers”. Therefore, the contract that is concluded for the provision of transport services will be made between you and the Suppliers.

DEPARTOURING, SL acts as reservation agent for the transportation services of the Suppliers, and our terms and conditions determine the bases under which we will make the reservations for the transportation services provided by our website. If you do not wish to be bound by our terms and conditions, then we will be forced not to process your request for a transport service on our website.

Important: All the transport services that we make available from our website cannot be considered as a combined trip, as stated in European Directive 2015/2302, of the European Parliament and of the Council, of November 25, 2015 and others. , relative to trips, vacations, combined circuits and any other European directive, applicable to its national legislation. You will verify for yourself that, even if you make more than one reservation at the same time, each one of them constitutes an independent contract between you and The Providers.

These terms and conditions configure the GENERAL CONDITIONS OF CONTRACTING THE RESERVATION , and that will be applicable on our website www.departouring.com , in order to carry out the contracting-reservation of our transport services.

User: is the person who accesses, uses or browses through our website www.departouring.com , and whom can contract the transport services we offer.

Legal Information: is the set of legal texts that make up our website, such as the GENERAL CONTRACTING TERMS AND CONDITIONS, the PRIVACY POLICY and the COOKIES POLICY. Documents all of them, which the user can access through the links provided at the bottom of our website.

For the purchase-reservation of all the transport services offered by DEPARTOURING, SL on its website www.departouring.com , and in which we act as direct agents on behalf of all transport providers, implies on the part of the User, his express consent and full compliance with the full content of the so-called Legal Information. Therefore, if the user does not agree with any of the terms set forth in these documents, please do not provide us with personal data, nor use our website, nor any of the services offered, nor carry out your purchase. or reserve.

It is always recommended to fully read all the legal information made available to the user before proceeding to contract any service offered on our website www.departouring.com . The information will always be up-to-date, and its content may be subject to change. The transfer purchase and reservation services offered on our website are intended for natural persons. If the user acts on behalf of a legal or professional person, please contact us via email info@departouring.com , before hiring or booking any transfer.

Based on the provisions of Law 34/2002, on Information Services and Electronic Commerce, the owner of the website www.departouring.com and of the files is DEPARTOURING, SL, with CIF B09979816, and address at Avenida Tres May 30, Floor 4, Office D, Santa Cruz de Tenerife, Canary Islands, Spain. Our address, as well as our email info@departouring.com , will serve to establish direct contact with us, so that the user can exercise their rights in data protection, and to file any complaint or claim.

To purchase transfers or reservations through our website, the user must be at least 18 years of age, and also be the owner of the means of payment with which they are going to make the payment, as well as having the legal capacity necessary to contract. If you are a minor, or do not have the necessary legal capacity, please refrain from using and contracting our services. If being a minor you decide to go ahead with the purchase of our services, you will have to have the express consent of your legal representatives. In the event of non-compliance with any of the aforementioned requirements, DEPARTOURING, SL disclaims any responsibility, and reserves the right to prevent the contracting of its products. In addition, in order to verify the age or the authenticity of the consent of their legal representatives, DEPARTOURING, SL reserves the right to request supporting documentation, without which it will not be able to process your request. In the case of minors, their legal representatives will be considered, in any case, responsible for the acts they may carry out, in accordance with the provisions of current regulations.

Identity theft in any form is expressly prohibited, as well as the use of means of payment of which the user is not the owner. At the same time, the provision of any personal data, not truthful by the user, is prohibited. The information provided through our website by the user must be truthful, and they are reminded that only they are responsible for any damage arising from false or fraudulent information, in which DEPARTOURING, SL could be involved or third parties.

2.- SERVICE REQUEST / RESERVATION PROCESS

To place an order, you can find a whole range of available transport services on our website. All orders must be placed at least 72 hours before your departure. It will always be your responsibility to ensure that both the pick-up address and the destination address that you or someone on your behalf has chosen are correct and accurate. The correction of any error made during the reservation process will be subject to our Changes and Cancellations Policy. Once again, we remind you that before making the reservation, check that all the names, dates and times are correct, and that, as soon as possible, notify us of any errors detected.

By providing us with your payment card details, it constitutes a guarantee that you are authorized to use it and that we can immediately charge it for the amount of the contracted services. We reserve the right to obtain validation of your payment card details before providing you with the service. If validation cannot be performed and payment is not made, we reserve the right to cancel the reservation on behalf of The Providers, who will then not perform the service.

For all those reservations that are generated successfully, with the different Providers, a reservation/booking will be generated, with all the details of your transfer and with contact details of the Service Provider with whom you have formalized a contract. It is your responsibility to verify the details of your reservation included in the reservation/booking before travelling, and to inform us of any errors. DEPARTOURING, SL is not responsible if the data entered at the time of making your request is incorrect.

We recommend printing not only the reservation/booking, which you must present to the Provider upon arrival, but also the different notifications that we have been able to send you. Every time we send you a notification, you must confirm receipt of it. In the event that you do not confirm it, and our records confirm that you have received it, it will be considered that you have acknowledged receipt of such. The provider can always reject the transfer, if the reservation receipt is not shown.

DEPARTOURING, SL as Agent of the Providers, will proceed to send your reservation request for the requested service to the Provider, and will be exempt from any error in the reservation/booking, unless we have made an error attributable to us. In case you detect any error in the reservation/booking, you must inform us 48 hours in advance. Once again we refer you to our Changes and Cancellations Policy.

DISABILITIES AND MEDICAL PROBLEMS: In the event that you or any member of your group with whom you are traveling has a medical problem or disability that may affect your transfer, please provide us with all the details before confirming your reservation, with the in order to advise you and find the best suitability for the service. You must also inform us if you or any passenger is a wheelchair user, and about the characteristics of the chair: if it is foldable and the measurements, and if it includes a battery or motor. All this in favor of the requested service being carried out with the correct vehicle.

SEATS FOR MINORS: Following European regulations on the mandatory use of seat belts, in vehicles less than 3.5T. (Directive 91/671):

3.- PRICES / PAYMENTS

IMPORTANT: The prices announced and confirmed, as well as other details on the website, may vary. For this reason, at the time of booking is when you must confirm the price of the chosen transfers.

The details of the prices of the different services, and the payment and delivery procedures, can be found on our website. The applicable price of any service is the price shown on our website for the date and time of your reservation. You must bear in mind that the price of any of our services may change before making your reservation. DEPARTOURING always tries to ensure that the prices displayed on our website are accurate, but the price of your reservation must be validated by us, as part of the acceptance procedure. By accepting these terms and conditions, once the price of the service has been confirmed, you waive your right to have the service fee calculated for a service outside the web, at the time of booking.

In the event that, once the reservation has been processed, the price of the service is higher than that indicated in your initial order, you will be informed first, and you will be able to cancel the reservation, or continue with it at the correct price. If you cancel the reservation, you will receive a refund of all the money you would have paid.

Payments will be made by credit or debit card at the time of booking, as established on our website, and at the time of payment, through any of the enabled gateways.

The online purchase/reservation through our website implies an obligation to pay by the user. The mean of payment enabled is our website and it will be by credit or debit card. The charges will be made in real time, once it is verified by the means of payment that the data is correct, being subject to verifications and authorizations of each of these means of payment, so that, if said entities do not authorize the payments, DEPARTOURING, SL will not be responsible for the successful completion of the online purchase/reservation. The security measures to be applied on the payment platform will be those provided by the banking entities, when making the payment by credit or debit card.

If you wish to receive an invoice in electronic format, you must notify us by email at info@departouring.com . The invoice will be issued in the name of the passenger whose data was provided, in the online purchase-reservation process. For any query or clarification regarding billing, please let us know by email at info@departouring.com

The prices shown on our website are expressed in euros (€), including the corresponding taxes. In this case, and as our tax office is in the Canary Islands, the tax will be the General Indirect Canary Tax (IGIC), as established by law. In the case of the existence of a voucher, you must print it, to present it to the driver of the vehicle on the day the service is provided.

4.- SPECIAL REQUESTS

In the event that you have any special requests, please let us know at the time of booking. DEPARTOURING will be in charge of transmitting them to the Suppliers, but what we cannot guarantee is that they will be fulfilled, and we will not be responsible to you for it. DEPARTOURING will not provide means of direct contact with the Suppliers, nor vice versa.

5.- CHANGES AND CANCELLATIONS OF THE CUSTOMER

Any modification that you want to make to your reservation will be subject to the availability of the Providers, and may even incur additional charges, and DEPARTOURING may also charge an administrative fee of up to €15 per reservation, for any modification of the services and cancellations. For any change or modification to your reservation, you must send us your request in writing to the email info@departouring.com , and DEPARTOURING will take care of sending it to the Suppliers. Changes or cancellations will not be valid until we receive them on behalf of the Providers, so we cannot guarantee that they can be fulfilled.

In the event that your reservation is a round trip, The Providers may refund the fare you paid for the unused part of that ticket, provided that the cancellation is made at least 48 hours before the date of travel.

For the total or partial cancellation of your reservation, it will always have to be done 48 hours before the departure time indicated on the tickets.

In the case of requesting changes when the passenger/client is at the place and time of collection or destination, flight information, number or age of the passengers, and this implies additional expenses, you must pay the additional cost at the time you make the change. This operation will not be subject to any management fee, as long as you have contracted the return on the same day.

In the event that the change results in a fare reduction, you will be offered a refund subject to a reasonable handling fee, provided these changes are made at least 48 hours prior to travel.

Changes made in the time of arrival at the collection point, and derived from the delay or early arrival of the flight, and delays in baggage collection or security controls, will not be considered changes in reservation, provided that they do not exceed 60 minutes in relation to the scheduled time.

Changes made within 48 hours of the first leg of a trip will be subject to a reasonable handling fee.

If The Suppliers need to make significant changes to their confirmed services, or cancel them, DEPARTOURING will inform you as soon as reasonably possible. Similarly, we will use reasonable efforts to find suitable alternative services for you, at no additional cost, but we will have no further liability with you.

In accordance with the provisions of article 103 a), of Royal Legislative Decree 1/2007 of November 16, on the Defense of Consumers and Users, the right of withdrawal will not be applicable to the contract with consumers and users, once the service has been fully executed, or when the execution has begun, as it is a service provision. Therefore, it is assumed that the user provides, from the moment he makes his reservation, his prior express consent, that once the contracted service has been carried out or started, he will have lost his right of withdrawal.

Likewise, where appropriate, in accordance with the provisions of article 103 I) of the aforementioned regulatory text, the right of withdrawal will not be applicable to the contract with consumers, as they are activities related to vehicle rental, if the contracts provide for a date or a specific execution period.

The following are grounds for termination of this contract: 1.- the mutual agreement of the parties 2.- the sudden impossibility, legal or material, of complying with the object of the contract. 3.- Failure to comply with the stipulated obligations. 4.- the current general legal causes.

6.- OUR RESPONSIBILITY

The service contract will be formalized between you and the Providers, and not between you and DEPARTOURING. As agents, we will not take any responsibility in relation to the provision of the service you have booked. We assume the responsibility of providing information on our website about the services available for reservations, providing the technology that allows you to make the reservation request that you have provided through our website, notifying you of any changes made by the Providers in your reservation, or inform the Providers about any modification or cancellation that you wish to make. We are not responsible for the losses that may arise from the incorrect processing of your reservation request, the service by your Provider, nor of the errors generated by not providing complete and specific information in the reservation request.

DEPARTOURING is not responsible for the information on the service, transmitted in good faith. The information on the services, the modes of transport, the duration of the trips, the pick-up and arrival times, the distances, is approximate and its purpose is merely informative.

We do not accept any responsibility for any illness, injury, death or loss of any kind. This includes the loss, damage or theft of any baggage or personal belongings that you or your party may be carrying. Any claim for loss, injury, illness or death, must be made directly with The Providers, or may be covered under the terms of your insurance.

In the event that we are held liable for you for any reason, our maximum liability to you is limited to twice the cost of your reservation, or the appropriate proportion thereof, and those who are in the reservation and are affected.

Occasional errors may appear on the website. Errors that we will endeavor to correct as soon as possible, as soon as we detect them. In the event that incorrect prices or promotions are published, we reserve the right to terminate the contract and offer you a full refund of the same.

We will not assume any type of responsibility for the additional services that you can book directly through your Provider.

7.- YOUR RESPONSIBILITY

You are solely responsible for carrying all the necessary documentation for your trip. Neither DEPARTOURING nor the Suppliers will be responsible for the losses derived from the failure to carry said documentation, or from not observing the regulations of the administration, or the tax, police or customs authorities of the countries to which you travel. The voucher or ticket is not a valid document to obtain entry visas.

You hereby agree to indemnify or reimburse us for any deposit, fine or disbursement that we must pay to the authorities for your failure to comply with the laws, regulations, etc…, or other travel requirements of the countries to which you wish to access, which pretend to leave or for those who are going to pass. In such event, we shall have the right to retain any monies due to you until full payment is made.

8.- FORCE MAJEURE

Force majeure means that neither we nor the Providers will pay you compensation, if we both have to cancel or change any service, due to unforeseeable circumstances, beyond our control or the providers. These circumstances include, but are not limited to, accidents and related delays, unplanned protest marches, organized demonstrations and riots, police operations, unforeseen road hazards, terrorist activities and their consequences. Likewise, by the threat of the following activities: riots, the act of any government or any other national or local authority, industrial litigation, natural or nuclear disaster, fire and adverse weather conditions, or other similar events, which are beyond the control of the Providers.

9.- COMPLAINTS / CLAIMS

In the event that you detect any problem in the contracted service, you must always notify DEPARTOURING, which will be in charge of initiating the pertinent investigations of what happened. Depending on the circumstances, the amount of compensation could be reduced, or even not receive any at all.

You can also contact DEPARTOURING through the email info@departouring.com , and we will act as a liaison with the Suppliers, striving to solve all the problems that exist with the contracted service.

Please note that any complaint must be received in writing, within 25 days of each service.

10.- BAGGAGE

All your luggage and that of the people who make up the reservation must be properly labeled with their names and destination address.

The maximum weight of each suitcase and per passenger is 20kg (dimensions: 158cms.). You can carry a handbag with a maximum weight of 5Kg. (dimensions: 45cm x 35cm x 20cm).

It is your obligation to declare any excess baggage when making your service reservation request. Therefore, you must bear the additional expenses you incur, which include the expenses derived from obtaining other vehicles to transport the excess baggage that you have not declared. We also reserve the right to refuse to carry excess baggage.

Prohibited items must not be included in the suitcases, such as: dangerous substances, animals, firearms, perishable products or fragile objects.

We also recommend that you do not include fragile or valuable objects in your luggage, such as jewelry, money, precious metals, silver objects, checks or other negotiable securities, passports and other identity documents, etc...

You must be responsible for your luggage at all times, and transport it at your own risk. Neither DEPARTOURING nor the Suppliers will assume any responsibility for the loss or damage thereof. We recommend hiring adequate travel insurance, which offers coverage against such eventualities.

In case of forgetting your luggage in the vehicle, it will be sent to the address that you have indicated in the service reservation request, which could entail an additional charge.

You must also tell us at the time of booking the service, if you are going to travel with pets. They will always travel at their own risk. We remind you that the

pets must travel in a container that meets IATA specifications for air transport. Pets tend to get very nervous during the trip, so you should take the necessary precautions. You must indemnify us for claims, expenses or other demands that we are subject to, as a result of the behavior of your pet.

11.- INSURANCE

Most Providers may require you to take out travel insurance as a condition of booking their services. Our recommendation is that you take out an insurance policy that covers you and your loved ones, against cancellation expenses incurred, for assistance expenses including repatriation, in case of illness, Provider bankruptcy, death, loss of luggage and money. , or other expenses.

12.- TRANSPORTATION SERVICES

Any of the Providers will always endeavor to arrive at the pick-up point at the time indicated in your reservation/booking, although its accuracy can never be guaranteed.

The maximum waiting time in private transfers will be 60 minutes from the arrival time of the flight specified in the reservation/booking. In the case of collection from any other point, the waiting time is limited to 10 minutes from the time specified in your reservation/booking.

We always recommend that you check in advance the date, time and place of collection that appears in your reservation/booking, and also check your email in case we have notified you of any changes by the Suppliers regarding your transfer. Likewise, when going to the departure airport, remind them that they must be there, within 120 minutes of the scheduled departure of their flight, to go through the check-in counter. DEPARTOURING is exempt from any responsibility, if the client misses the flight for not making the reservation sufficiently in advance.

In private transfers, Suppliers have the power to decide the route to reach their destination, even if it is not the most direct route. Likewise, the Suppliers will not be responsible for delays, or services not provided due to force majeure, or due to unforeseeable circumstances beyond their control, such as accidents suffered by third parties during the transfer route, police controls, terrorist attacks or acts vandalism, adverse weather conditions, or manifestation.

Our transfers will always be made between the collection and destination points, which you have specified in your reservation/booking. For this reason, we ask that you always provide us with a well-detailed and specific address, correctly completed, such as street name and number. The Suppliers will always pick you up or drop you off at the closest place to your accommodation, depending on the characteristics of the vehicle, and the access to the place of destination.

All the vehicles of our Suppliers are insured, as required by national regulations.

As indicated in point 2 of our Terms and Conditions, we remind you that, if the reservation of the service includes the transfer of minors, you must inform it at the time of making the reservation. If the presence of minors is not reported, the transfer service is subject to the availability of seats suitable for minors in the vehicle. If there is no availability, the price of the service cannot be reimbursed, nor will any responsibility or obligation be assumed to provide the transfer service.

In our pick-up services at the point that you have indicated, if you are not there, after 10 minutes of the time specified in your reservation/booking, we will try to contact you through the mobile phone number that you have provided us as soon as we get notified of the "no show" condition. If we are unable to contact you due to lack of coverage, poor or no signal quality, or going to voicemail, or our call is not answered, the service will not be provided, and neither the Provider nor DEPARTOURING will be obliged to provide it or reimburse it.

TYPES OF SERVICES

Shared service or Shuttle service:

It consists of the shared transfer with more users, from their arrival at the airport to their accommodation, or from their accommodation to the airport. The indicated prices are always prices per person.

 

VIP Service:

It consists of the transfer with a high end vehicle, equipped with highly comfortable seats, personalized attention and a private driver. The indicated prices are always per vehicle.

 

 

Private service:

It consists of the transfer with a private vehicle and driver. The established prices are prices per vehicle.

 

Wheelchair Adapted Service (WAV):

It consists of a private transfer with vehicles adapted for people with reduced mobility. The established prices are per vehicle.

13.- CONTACT

The email and mobile phone, indicated in your online reservation, will be the means by which we will communicate with you, which is why we urge you to always consult them before traveling, since any anticipated change or cancellation in your contract with the Suppliers, we will notify you to the means that you have previously indicated. You may also be provided with any other information that may be useful to you.

It is your obligation to keep us informed of any change in your contact information, both mobile phone and email, so that we can communicate with you in the event of any incident or notification that we have to make to you.

14.- RIGHT OF ADMISSION

Both the Suppliers and the driver of the vehicle reserve the right to refuse to transfer any person who is under the influence of alcohol, drugs, or whose behavior may be considered dangerous for the driver or the rest of the people who make up the vehicle transfer, including you. In these cases, there will be no refunds, nor will any responsibility be assumed regarding the provision of the service, neither to you nor to any person traveling with you, nor will alternative solutions be proposed.

Remember: the consumption of alcohol, narcotic substances or tobacco is not allowed inside any vehicle.

15.- LANGUAGES

Our web pages are available in several languages. Our customer service and email support is available in Spanish and English, which will be the main languages ​​in which the service will be provided. We monitor the quality of the translation of our web pages and our terms and conditions. In case of any discrepancy, the Spanish version will prevail.

16.- INTELLECTUAL PROPERTY

DEPARTOURING is the owner of its brand and logos, both being registered, on which the intellectual property rights are established, and being protected by national and international regulations, including our website.

The use of the content of our website, reproductions or total or partial representations of it, including subsequent modifications and publications, without our express consent, is strictly prohibited.

17.- COMPETENT JURISDICTION

The conditions of sale of our services are subject to the laws of Spain, and any discrepancy will be resolved before the Courts of Santa Cruz de Tenerife. In the case of Suppliers, they will specify the applicable law in their contract. All this without prejudice to expressing our willingness to resolve any dispute previously in an amicable manner.

If any of the clauses or texts included in these General On-Line Contracting Conditions and reservation conditions are declared invalid, the General On-Line Contracting Conditions and reservation conditions will continue to be fully effective and binding for the parties in the same terms, provided that they can subsist without the clauses or texts declared null.
